Pure Romania Terms and Conditions
Pure Romania terms and conditions could be amended from time to time. Every modification will be announced and highlighted in this section. By accessing our services and our media channels using any mean of communication, you acknowledge and agree to have read, understood and agreed to Pure Romania terms and conditions and the privacy statement.
1. Scope of our Service
Pure Romania is a tourism web platform from Romania which provides full information about travelling to Romania and proposes a set of tours available for booking. Pure Romania is available online through its website www.pure-romania.com, and through social media platforms such as: Facebook, Twitter, Instagram, LinkedIn, Pinterest etc.
All the information that we distribute through our media channels is verified by our staff. We do our best in order to provide complete, accurate, correct information. We don’t guarantee the information provided. We only guarantee the engagement that we took about our tours – to offer the services we presented to our clients.
We don’t assume responsibility for our partners’ website content which is linked to our website.
2. Our contract
All bookings are made with Pure Romania (Leader SMS Mobile S.R.L Company from Romania, check the government authorization in the about us page). By booking a trip with Pure Romania you are deemed to have agreed to these Terms and Conditions (which are the basis for the entire agreement between you as a costumer and us as a service provider). The booking you will make will be accepted by us on that basis. The services to be provided are those referred to in your booking confirmation invoice. The invoice will be generated and transmitted after the payment is made.
Dates, itineraries and prices are valid from 1st of January 2014 until 31st of December 2014.
We offer two types of tours: standard tours (tours that are operated by respecting a standard route and schedule, and which will bring people together) and private tours (tours that are built in correlation with clients’ special requirements and that are offered exclusively for them). Both types of tours could be one-day tours or long tours (lasting for more than one day).
5. Booking process
You can book our tours directly, by using our website www.pure-romania.com. There is also the availability to purchase our tours from the partners that are promoting and selling our tours; for these situations please refer to their terms and conditions. You can only book if you have at least 18 years old.
Booking process for long tours.
In the booking section please choose the tour that you want to book. Choose the start date (only the starting days are available for selection). Press the book now button and fill in the form. After this you will receive an automatic message that informs you about the request. After the validation, one of our team members will offer you further information regarding the acceptance process and the invoice for the 50% deposit. You can make the payment by using a PayPal account.
Booking for private short days.
The process is almost the same. After validation you will receive a document in order to fill in your preferences. After submitting this document, you will receive our proposal regarding the custom made tour and the 50% deposit invoice. You have to make the payment for the deposit with at least 5 days in advance.
Booking standard short tours
The process is almost the same as for the long tours. You will receive a confirmation via email regarding the acceptance status, and an invoice for the tour. You can pay the invoice in the morning of the day you will take the tour. You don’t need to pay in advance.
6. Deposit requirement
You are required to pay a non-refundable deposit of 50% of the full value of the tour (per person, per trip) for your booking to be confirmed. This rule is applicable for standard long tours and for all private tours. The one day standard tour does not require a deposit. The deposit will be made through the PayPal system based on an invoice transmitted via email. Other ways of paying can also be accepted, but only after an express request from the client.
For long tours (standard and private) the deposit must be made with at least 30 days in advance.
For the one-day private tour the deposit must be made with at least 5 days in advance.
One-day standard tour doesn’t need a deposit.
Booking in advance for long tours and making the deposit with at least 45 days ahead offers you a 5% discount from the total price.
If you pay 100% of the cost of the trip with at least 30 days before departure, you will get a discount of 5% from the total price.
7. Acceptance of booking and final payments
If we accept your booking we will issue a confirmation invoice. A contract will exist between us from the date we issue the confirmation invoice; other option is if you book within 7 days of departure, then the contract will be in effect from the date we accept your deposit. Please refer to your booking confirmation invoice for details regarding final payments. Payment of the balance of the trip price is due 30 days before the departure date for long tours (private and standard) and 5 days for one-day private tour. The remaining amount of money will be paid by the tourist in the first day of the tour. If this balance is not paid before the due date, we reserve the right to treat your booking as cancelled.
Please note that the prices are established in accordance with accommodation in double rooms; for singles the price will be higher. When filling in the booking form, please specify the room type (single) in order to receive the updated price.
Our tours are configured in order to allow each person to carry 2 big travel bags. Please inform our staff for heavy or special luggage, such as playing instruments or sports equipment. For extra big luggage you may be extra charged.
8. Your details
In order for us to confirm your travel arrangements you must provide all requested details with the balance of the trip price. Necessary details include full name as per passport, date of birth, nationality, passport number, passport issue and expiry date and any pre-existing medical status which may affect your ability to complete your travel arrangements. If you are 70 years of age or over we also require you to complete and forward a Self-Assessment form. Your booking cannot be confirmed without provision of these details.
9. Cancellation by the traveler
If you cancel some or all portions of your booking cancellation, fees will apply. A cancellation will only be effective when we receive written confirmation of the cancellation. If you cancel a trip:
• 30 days or more prior to departure, we will retain the deposit
• less than 30 days prior to departure, we will retain 100% of the total amount paid by you in connection with the booking.
We suggest you to take into consideration rescheduling your journey; by doing so you will be able to save the amount you have already paid. Please pay attention – you can reschedule your journey only for a date within the next 12 months.
Please note that for certain travel arrangements the cancellation charge may be higher than those mentioned above. In certain cases a cancellation fee of 100% applies as soon as the booking is made and the ticket is issued. Please ask for full details about cancellation charges when booking. If you leave a trip for any reason after it has commenced, we are not obliged to make any refunds for unused services.
10. Cancellation by Pure Romania
We may cancel a trip at any time up to 30 days before departure. We may cancel a trip at any time prior to departure if, due to terrorism, natural disasters, political instability or other external events it is not viable for us to operate the planned itinerary. If we cancel your trip, you can transfer the amounts already paid to an alternate departure date, or alternatively receive a full refund. In circumstances where the cancellation is due to external events outside our reasonable control, the refunded amount will not contain any unrecoverable costs. We are not responsible for any incidental expenses that you may have incurred as a result of your booking, including but not limited to visas, vaccinations, and travel insurance excess or non-refundable flights.
11. Booking amendments
If you wish to transfer from one trip to another or transfer your booking to a third party, you must notify us at least 30 days prior to the suggested departure date.
If you notify us less than 30 days prior to the proposed departure date the refund policy applicable to cancellations will apply. Transfers to a third party are only permitted where the transferee meets all the requirements in relation to the trip, and transfers to another departure can only be made to a departure within the current validity period.
Amendments to any other arrangements made in conjunction with your trip will incur a $100 administration fee per booking per change. This fee is in addition to any charges levied by hotels, ground operators or airlines. No amendments are permitted to your booking within 15 days of departure. You can reschedule your trip by picking a new date within the next 12 months. You cannot reschedule for a different period of time.
Children under 10 years old could be hosted without extra charges with their parents.
The land price of your trip includes:
For long tours:
• all the tours are all inclusive; this means that all the tourists will receive 3 meals with drinks each day.
• accommodation as listed in the Pure Romania Tours Presentation
• transport as listed in the Pure Romania Tours Presentation
• sightseeing as listed in the Pure Romania Tours Presentation
• the services of a group leader which will also be a well prepared guide – as described in the Pure Romania Tours Presentation
• Transfer from Henry Coandă International Airport to Bucharest
• Transfer to Henri Coandă International Airport for departure
For Short tours:
• transport as listed in the Pure Romania Tours Presentation
• Sightseeing as listed in the Pure Romania Tours Presentation
• The services of a group leader which will also be a well prepared guide as described in the Pure Romania Tours Presentation
For private tours:
– This may vary; a full description will be sent via email with the invoice. In most cases these tours will include the facilities that standard tours offer, alongside with other optional facilities.
The land price of your trip does not include:
• international or internal flights unless specified
• meals other than those specified in the Trip Description
• Visa and passport fees
• travel insurance
• Optional activities and all personal expenses.
14. Prices & surcharges
Our prices are expressed in EURO, although you can pay in USD, GBP, CAD and AUD. The parity that we consider at Pure Romania is the one provided by http://www.xe.com/currencyconverter/. When you pay in different currencies, please specify in the booking forms in order to receive an invoice in the correct currency.
15. Age & Health requirements
Minimum General Policy: For the majority of our trips the minimum age for children is 12. All travelers under the age of 18 must be accompanied by an adult who is responsible for the child’s day-to-day care. Pay attention, when you leave the country you may be asked for evidence or documents that grant you the right to accompany the children. Please note that we cannot guarantee triple or joining rooms for families; accompanying adults may be required to share with others within the group on a twin share basis. Variations: A minimum age of 18 applies to many Pure Romania adventures, while a lower minimum age applies to Family trips and Short Break Adventures. Please read carefully the tour description.
Maximum General Policy: For the majority of our trips we have no upper age limit, though we remind you that our trips can be physically demanding and a Self-Assessment form is required for all passengers aged 70 or more.
We are able to provide details on mandatory health requirements; however, we are not medical experts. It is your responsibility to ensure that you obtain proper and detailed medical advice at least two months prior to the trip for the latest health requirements, recommendations for your destination and any costs. Where you do not do so and either you are not allowed to enter any country, or suffer personal injury or death as a result, we have no liability to you for any cost, loss or damage which you suffer nor will we refund you the cost of any unused portion of your travel arrangements.
16. Guarantee of departure
Our trips are guaranteed to take place once they have one booking reservation with deposit. This means that at times we can have small groups. Please notice that a minimum group of 4 persons is required for a standard tour; if this number of people is not met, the standard tour will be automatically transformed into a private tour. This change doesn’t involve any additional costs.
17. Passport and visas
You must carry a valid passport and have obtained all the appropriate visas, permits and certificates for the countries which you will visit during your trip. Your passport must be valid for six months beyond the duration of the trip. It is your responsibility to ensure that you are in possession of the correct visas, permits and certificates for your trip; please refer to the FAQs for details. We are not responsible if you are refused to enter a country because you lack the correct passport, visa or other travel documentation.
18. Travel insurance
Travel insurance is compulsory for all Pure Romania travelers and should be presented at the time of booking. Your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of US $200,000 for each of the categories of cover. We also strongly recommend it covers cancellation, curtailment, personal liability and loss of luggage and personal effects. You must provide proof of your travel insurance on the first day of your trip; you will not be able to join the trip without it. If you obtain travel insurance through us you acknowledge that you are satisfied with the level of insurance we have arranged. For instance we provide travel insurance only in case of express request.
You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility and you should allow for alternatives. The itinerary provided for each trip is representative for the types of activities contemplated but it is understood that the route, schedules, itineraries, amenities and transportation may be subject to alteration without prior notice due to local circumstances or events.
20. Change of itinerary
While we endeavor to operate all trips as described, we reserve the right to change the trip itinerary. Please refer to our website before departure for the most recent updates to your itinerary.
Before departure: If we make a major change we will inform you as soon as reasonably possible, if there is time to do so before departure. The definition of a major change is deemed to be a change affecting at least one in five days of the itinerary. When a major change is made you may choose between accepting the change, obtaining a refund of money paid on the land portion of the trip only or accepting an alternative offered tour.
After departure: We reserve the right to change an itinerary after departure due to local circumstances or events outside of our control. In such emergency circumstances the additional cost of any necessary itinerary alterations will be covered by you. Please note we are not responsible for any incidental expenses that may be incurred as a result of the change of itinerary such as visas, vaccinations or non-refundable flights.
21. Authority on tour
Our group trips are run by a group leader. The decision of the group leader is final on all matters likely to affect the safety or well-being of any person participating in the trip. If you fail to comply with a decision made by a group leader, or interfere with the wellbeing or mobility of the group, the group leader may direct you to leave the trip immediately, with no right of refund. We may also elect not to carry you on any future trips booked. You must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited, and you also agree to travel in accordance with our responsible travel guidelines.
22. Acceptance of risk
You acknowledge that the nature of the trip is adventurous and participation involves a degree of personal risk. We use information from government foreign departments and reports from our own contacts in assessing whether the itinerary should operate. However, it is also your own responsibility to acquaint yourself with all possible relevant travel information and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks attendant upon such travel.
23. Limitation of liability
We contract with a network of companies, government agencies and individuals to assist in the running of our trips as agent for these third parties. We are not responsible for the acts and omissions of these third parties.
To the fullest extent permitted by law:
• liability for any loss, death, injury or damage which you may suffer (directly or indirectly) in connection with or arising out of your participation in a trip, or any breach of the Booking Conditions, is excluded.
• you release us and our officers, employees, agents and representatives from any liability and expressly waive any claims you may have against us arising out of or in connection with your participation in a trip.
• any condition or warranty which would otherwise be implied by law into these Booking Conditions (Implied Warranty), is excluded.
To the extent an Implied Warranty cannot be excluded, our liability in respect of the Implied Warranty is limited to (in our absolute discretion): (i) the provision of a similar trip to an equivalent value; or (ii) a refund of the total amount received by us from you in connection with your booking.
Any claim by you is excluded to the extent that it is for indirect or consequential loss, loss of profits or economic loss, however it arises, or for indirect, special, punitive or exemplary damages.
We do not accept responsibility for any damage or loss in your luggage.
24. Additional activities not included in the trip price do not form part of the trip or this contract.
You accept that any assistance given by your tour leader or local representative in arranging optional activities does not render us liable for them in any way. The contract for the provision of that activity will be between you and the activity provider.
25. Claims & complaints
If you have a complaint about your trip please inform your tour leader or our local representative at the time in order that they can attempt to rectify the matter. If satisfaction is not reached through these means then any further complaint should be put in writing to us within 30 days of the end of the tour.
In the event that any term or condition contained in these Booking Conditions is unenforceable or void by operation of law or as being against public policy or for any other reason, then such term or condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding.
27. Photos and marketing
You consent to us using images of you taken during the trip for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, worldwide, irrevocable license to use such images for publicity and promotional purposes.
29. Applicable law
The laws of Romania govern these Booking Conditions to the fullest extent allowable. Any disputes in connection with a trip or with these Booking Conditions must be initiated with the courts of Romania.
Pure Romania website and Pure Romania materials presented on our social media profiles are protected by copyright and other intellectual property rights. This rule also applies to any third party content provided for Pure Romania website and social media channels. You have the permission to access, view and share the information only on social media channels (only by providing the link for the information source). You don’t have the permission to integrate Pure Romania website or social media profiles into any website. For further rights on Pure Romania materials you have to obtain Pure Romania written acceptance.
We fully value our clients, and therefore we have a high degree of respect for their privacy.
We are responsible for processing any personal information you provide to this Web site and we are notified, where required, in each country under the relevant data protection legislation of that country.
Personal information (information about you that is personally identifiable), such as your name, address, email address, or phone number will be used for travelling purposes only. The information may also be provided to the authorities as required by law.
You agree that the information you provide or that is obtained by us will be used in order to enable us to review, develop and improve the services which we offer and provide you (via mail, email telephone or otherwise) with information about new products, services and special offers we consider you will find valuable. We may also inform you about new products and services and special offers of selected third parties.
